Data Subject Request Guidelines

What is a Data Subject Request (DSR)?
At Barita Investments Limited, we hold the privacy and rights of our customers in high regard. As a Data Subject, you have the right to access information pertaining to the collection, utilization, storage, and disclosure of your personal data. A DSR is a formal request submitted by a data subject (or their delegate) for information about their data which is currently held by our organization.

How do I file a Data Subject Request (DSR)?
You are required to complete and sign a form specifying the type of request. In order to submit the form, you will need to provide personal data that will allow our team to verify your identity before the data request can be addressed. You may delegate someone on your behalf to submit a request and receive the updates, however, you must use the delegation form and provide information to verify the person you have delegated. Once you have completed the form, you must sign it and return the physical signed (or notarized copy) to one of our branches for processing. Note the officer that receives your request will need to verify that you are the data subject or are authorized to submit the request on behalf of the data subject.

Below you will find the steps to initiate a Data Subject Request (DSR). In accordance with legal requirements, Barita is obligated to provide a response within 30 days.

 

 

Which form should I complete?

  1. Delegation Form 
    In instances where your request involves giving explicit consent or authorization for someone else (the delegate) to view, use, or manage your personal data, complete the Delegation Form. Due to the nature of this request, it is a requirement that this form be signed by a Justice of the Peace or Notary Public.
  2. Request for Access to your Personal Data
    This form is designed to enable you to exercise your rights regarding your personal data, its intended purpose, the recipients with whom the data is shared, and how it is being processed.
  3. Notice to Prevent Processing
    This form is to be completed if you wish for Barita to discontinue the processing of your personal data.
  4. Notice to Prevent Automated Decision Making
    As a valued customer of Barita Investments Limited, you reserve the right to stipulate that your data be excluded from automated activities or decisions.  You may therefore submit a request, asserting your choice to opt out of processing through automated means.
  5. Request for Rectification
    A formal request intended for correcting or updating your personal data. As a Customer of Barita, you have the right to ensure that the personal data held about you is accurate and up to date.

What to do once the form is completed?
Once you have completed the printed form, please return it to nearest branch for verification and processing. To ensure the security of your personal data, we require verification of your identity. As such, a copy of a government-issued ID (passport or driver’s license) should accompany the completed form.

Once received, your form will be routed to the organization’s Head of Privacy for processing, and you will receive a response to your request within 30 days of submitting it to our branch location.

Is there a cost for fulfilment of the request?
There is no cost for you to submit a data subject request and in most cases, the information you requested will be provided electronically. If you request information to be provided in other formats, this will likely attract a fee. There may be other types of requests that are subject to a fee. In such an instance, the Head of Privacy will contact you.
